Why Every Freelancer Needs a Contract

Breaking Down Each Section

1. Scope of Services — The Most Important Section

Vague scope is the #1 cause of freelance disputes. "Website design" is not a scope — "5-page responsive website design with homepage, about, services, portfolio, and contact pages using Figma" is a scope.

The more specific you are here, the less room there is for misunderstandings. Also include what is explicitly not included: "This agreement does not include copywriting, photography, or ongoing maintenance."

2. Timeline — Build in Buffer

Always tie your timeline to client responsiveness. If they take 2 weeks to provide feedback instead of 3 days, your delivery date should shift accordingly. This clause protects you from "you are late!" accusations caused by client delays.

3. Payment — Get a Deposit, Always

A 50% upfront deposit is industry standard. It filters out non-serious clients and protects your cash flow. For larger projects ($5,000+), consider breaking it into 3 payments: 33% upfront, 33% at midpoint, 34% on delivery.

4. Revisions — Set Clear Limits

Without revision limits, projects can drag on forever. Two rounds of revisions is standard. Define what counts as a "revision" — minor text changes are usually not a revision, but redesigning an entire section is.

5. Intellectual Property — Protect Your Work

The golden rule: ownership transfers only upon full payment. This gives you leverage if the client tries to use your work without paying. Also, always reserve the right to use the work in your portfolio.

6. Termination — Plan for the Worst

Digital Contracts vs. Paper Contracts

Digital contracts (signed via email or e-signature tools) are legally binding in most countries, including the US (ESIGN Act), the EU (eIDAS Regulation), and the UK (Electronic Communications Act). Printing and scanning is no longer necessary.

Options for digital signing include Google Docs (accept via email), DocuSign, HelloSign, or simply having both parties reply "I agree" to an email containing the contract. All are legally valid.
